Licensing for Montana Operators

Montana Cannabis License Types: A Complete Guide for Operators (2026)

Montana operates both a medical and adult-use cannabis market under the Montana Marijuana Regulation and Taxation Act (MMRTA), codified at Title 16, Chapter 12 of the Montana Code Annotated (MCA). Medical marijuana has been legal in Montana since 2004 through Initiative 148. Adult-use cannabis was legalized through Ballot Initiative 190 in November 2020, and retail sales to adults 21 and older began on January 1, 2022. The administrative framework for both programs is implemented by House Bill 701 (2021), which created the Cannabis and Alcohol Regulation Division (CARD) within the Montana Department of Revenue as the single licensing and regulatory authority.

Montana's cannabis market carries two conditions that are essential context for any operator or prospective applicant in 2026. First, a moratorium on new business locations has been in effect since July 1, 2025 no new licensed premises are being issued until at least July 1, 2027, when the Department of Revenue will begin accepting applications from operators and for premises not previously licensed. Existing licensees may relocate to new premises if permitted by local ordinances. Second, Montana's adult-use market is geographically divided: adult-use sales are only permitted in counties that voted in favor of Initiative 190 in November 2020 ("green" counties), or in counties that have since voted to opt in. Operators in counties that voted against I-190 may not sell adult-use cannabis unless a subsequent local election approves it.

Montana's licensing structure is designed for vertical integration. A single business entity may hold a cultivator license, a manufacturer license, and a dispensary license simultaneously, and may operate multiple sites under each license type. There is no requirement to hold multiple license types an operator may hold any combination, or only one. Every proposed location must be individually applied for, inspected, and approved by CARD before operations can begin, regardless of how many locations are already licensed under that business.

All cannabis businesses in Montana are required to use Metrc as the mandatory statewide seed-to-sale tracking system. Every plant, package, and product transfer must be recorded in Metrc from the point of cultivation through final retail sale. All sales must be entered in the system before or at the point of transaction.

Montana Cannabis License Types

Cultivator License

The cultivator license authorizes a licensee to plant, cultivate, grow, harvest, and dry marijuana, and to package and relabel marijuana produced at the licensed location in a natural or naturally dried form. Cultivators may sell marijuana to other licensed businesses or through their own licensed dispensary. Cultivators may not sell directly to medical cardholders or adult-use consumers all consumer sales must occur through a licensed dispensary. Cultivators are permitted to transport their own product between their own licensed facilities without a separate transporter license.

All new cultivation sites in Montana must be indoor only. There is a narrow exception: former medical marijuana licensees who conducted outdoor cultivation before November 3, 2020 may continue outdoor cultivation at existing locations, but may not expand their outdoor space. For all practical purposes, any new cultivation entrant must operate an enclosed indoor facility.

Montana uses a 13-tier canopy licensing system for cultivators. Each tier specifies a maximum total canopy square footage and a maximum number of indoor cultivation facilities that may be operated under that single license. Canopy is defined under Montana law as the total square footage dedicated to live plant production at a licensed premises, measured as the floor, platform, or means of support of the plant. The annual license fee is set by tier and applies to the license as a whole it is not applied separately to each facility location under the license.

The 13 tiers and their corresponding annual fees under 16-12-223, MCA are as follows: the Micro tier allows up to 250 square feet at one facility for an annual fee of $1,000. Tier 1 allows up to 1,000 square feet at one facility for $2,500 per year. Tier 2 allows up to 2,500 square feet at up to two facilities for $5,000 per year. Tier 3 allows up to 5,000 square feet at up to three facilities for $7,500 per year. Tier 4 allows up to 7,500 square feet at up to four facilities for $10,000 per year. Tier 5 allows up to 10,000 square feet at up to five facilities for $13,000 per year. Tier 6 allows up to 13,000 square feet at up to five facilities for $15,000 per year. Tier 7 allows up to 15,000 square feet at up to five facilities for $17,500 per year. Tier 8 allows up to 17,500 square feet at up to five facilities for $20,000 per year. Tier 9 allows up to 20,000 square feet at up to six facilities for $23,000 per year. Tier 10 allows up to 30,000 square feet at up to seven facilities for $27,000 per year. Tier 11 allows up to 40,000 square feet at up to eight facilities for $32,000 per year. Tier 12, the largest tier, allows up to 50,000 square feet at up to nine facilities for $37,000 per year.

All applications require a non-refundable processing fee of 20% of the license fee, due at the time of application submission regardless of whether the application is approved. Licenses are issued for one year and must be renewed annually. Renewals must be submitted at least 60 days before expiration CARD does not grant extensions.

New cultivators entering at or after the July 1, 2027 opening may only begin at the Micro, Tier 1, or Tier 2 license level. Tier increases beyond the starting point are available only at the time of annual renewal, and only one tier increase may be requested per renewal cycle. To be approved for a tier increase, the cultivator must demonstrate three things: the cultivator is currently using the full amount of canopy already authorized; the seed-to-sale tracking system shows the cultivator has sold at least 80% of production from the existing licensed square footage over the two prior quarters or can otherwise demonstrate a market for the additional product; and the proposed new or expanded facility is located in a qualifying jurisdiction under 16-12-301, MCA.

Dispensary License

The dispensary license authorizes a licensee to sell marijuana and marijuana products to consumers. Montana issues dispensary licenses as either medical-only or adult-use. A medical-only dispensary may sell exclusively to registered medical cardholders. An adult-use dispensary may sell to registered cardholders and to any adult consumer aged 21 or older. Dispensaries may purchase marijuana and marijuana products from any other licensed business and may also sell product cultivated or manufactured by the same business entity.

Dispensaries may not allow on-site consumption under any circumstances. All sales must be entered into the Metrc seed-to-sale tracking system at the point of transaction. On-site consumption, regardless of form, is prohibited at licensed dispensary locations.

Every dispensary location is licensed individually. A business holding a dispensary license may operate multiple dispensary locations, but each location must submit its own application, pass its own inspection, and receive separate CARD approval before opening. The dispensary license fee is $5,000 per location annually. Applications require an additional non-refundable processing fee of 20% of the license fee at submission.

Before operating, each dispensary location must demonstrate it is located within a jurisdiction that allows cannabis businesses to operate under 16-12-301, MCA. For adult-use dispensaries specifically, this means the county must be a green county (having voted in favor of I-190 in 2020) or must have held a subsequent local election approving adult-use sales. Dispensaries located in jurisdictions that allow adult-use sales may face an additional local option cannabis sales tax of up to 3%, if the local government has enacted one. Of this local option revenue, 50% is retained by the county, 45% is distributed to municipalities within the county based on population ratios, and the Department of Revenue retains 5% for administrative costs.

Every dispensary location must pass both a fire inspection by the authority having jurisdiction and a CARD inspection before beginning operations. Montana towns, cities, and counties have the option to enforce local building codes in full or in part operators should confirm which building code jurisdiction applies to their proposed location before investing in build-out.

Manufacturer License

The manufacturer license authorizes a licensee to convert or compound marijuana into marijuana products, marijuana concentrates, or marijuana extracts, and to package, repackage, label, or relabel marijuana products as allowed by Montana statute and administrative rule. Manufacturers may purchase marijuana from licensed cultivators and may sell the finished products they manufacture to other licensed businesses. Manufacturers may not sell directly to medical cardholders or adult-use consumers all consumer-facing sales must go through a licensed dispensary. Manufacturers are also permitted to transport their own product between licensed facilities without a separate transporter license.

New manufacturers may enter at any tier of their choosing and may change tiers only at the time of annual renewal. Manufacturing license fees are annual and are based on the amount of concentrate the licensee produces per month. Tier 1 applies to manufacturers producing up to 10 pounds of concentrate per month, with an annual license fee of $5,000. Tier 2 applies to manufacturers producing between 10 and 15 pounds of concentrate per month, with an annual license fee of $10,000. For manufacturers producing more than 15 pounds of concentrate per month, the base annual fee is $10,000 plus an additional $1,000 for each pound produced above 15 pounds per month. This progressive structure means that high-volume concentrate producers face significantly increasing annual fees at scale, and operators should model their expected production against this fee structure before selecting a tier.

All applications require a non-refundable processing fee of 20% of the license fee. All manufacturing locations must comply with the same local jurisdiction requirements under 16-12-301, MCA and are subject to CARD inspection before operating.

Testing Laboratory License

The testing laboratory license authorizes an independent entity to provide testing of representative samples of marijuana and marijuana products and to report on their chemical composition, potency, and the presence of molds, pesticides, or other contaminants. All cannabis and cannabis products in Montana must be tested and pass state-mandated standards before they can be sold to medical cardholders or adult-use consumers through any dispensary. Testing laboratories are the only entities authorized to perform this compliance testing.

The licensing process for testing laboratories is a two-step sequence. Applicants must first receive an endorsement from the CARD Testing Laboratory Program, which performs the initial application evaluation. Only after receiving this endorsement may a laboratory proceed to apply for formal licensure through the CARD Licensing and Inspection unit. Applicants must submit a scientific director's resume, proof of insurance, and a surety bond as part of the initial application. Testing laboratories may also optionally apply for a storage facility endorsement, which permits temporary off-site storage of marijuana and marijuana products pending analysis.

The testing laboratory license fee is $5,000 annually. All applications require a non-refundable 20% processing fee at submission. All testing lab locations must pass a CARD facility inspection before commencing operations.

Transporter License

The marijuana transporter license, created by House Bill 701 in 2021, authorizes a third-party business to provide logistics, distribution, delivery, and storage of marijuana and marijuana products between licensed facilities and to registered medical cardholders. Licensed transporters may not deliver cannabis to adult-use consumers delivery to adult-use consumers is not authorized under any Montana license type. All transport must originate from a licensed premises and be delivered to a licensed premises or a registered medical cardholder's address of record, and must be accompanied by a transport manifest generated from the seed-to-sale tracking system.

A critical operational distinction: licensed cultivators, manufacturers, dispensaries, and testing laboratories may each transport their own marijuana and marijuana products between their own licensed facilities without holding a transporter license, provided all transport complies with seed-to-sale tracking rules and is accompanied by a printed manifest. The transporter license is primarily for third-party logistics businesses contracting with multiple licensees. A licensed transporter may contract with multiple licensed businesses simultaneously. All persons transporting cannabis while working for a transporter must hold a valid Montana driver's license and a current marijuana worker permit. No unauthorized persons may be present in the transport vehicle while marijuana is onboard.

The transporter license fee is $10,000 for a two-year license period unlike other Montana cannabis license types, the transporter license is valid for two years rather than one. Transporters wishing to store cannabis overnight or temporarily at an off-site location must apply for an optional storage facility endorsement, which carries an annual fee of $1,000. All applications require a non-refundable 20% processing fee at submission.

Combined-Use License

The combined-use license is a special license category established under 16-12-225, MCA and available exclusively to Montana's eight federally recognized Native American tribes or to business entities majority-owned by one of those tribes. Each federally recognized tribe in Montana may hold at most one combined-use license, and no more than eight combined-use licenses may be issued statewide. A combined-use license combines a cultivation license (starting at a Tier 1 canopy allowance) and one dispensary license, both required to operate at the same licensed premises.

Combined-use licensees must operate within a green county and within 150 air miles of the exterior boundaries of the reservation. For the Little Shell Chippewa Tribe, the 150-mile radius applies from the tribal services area rather than a reservation boundary. Combined-use licensees are exempt from the moratorium that applies to other license types applications for combined-use licenses are available now, independent of the July 2027 reopening date that applies to other new entrants.

Combined-use licensees may increase their cultivation tier faster than standard licensees: they may advance up to Tier 5 in a single step without meeting the 80% sell-through and full-canopy-utilization requirements that standard cultivators must satisfy for tier increases. The combined-use license fee is $7,500 per year. A non-refundable 20% processing fee applies at application submission.

Marijuana Worker Permits

A marijuana worker permit is required for every individual who participates in any part of a marijuana business in Montana owners, employees, volunteers, and, following 2025 legislative changes, third-party contractors performing work on behalf of a licensee on a regular basis. The permit must be worn visibly at all times while performing work at a marijuana business. Worker permits are issued to the individual, not the employer, and may be used concurrently across multiple marijuana businesses if a worker is employed by more than one licensee. Permits may not be transferred to another individual.

Workers must be at least 18 years of age to obtain a worker permit. Montana residency is not required for workers only business license applicants (with 5% or more financial interest) must demonstrate one year of Montana residency. The annual worker permit fee is $50, plus a separate background check fee applicable to owners and laboratory workers. Replacement cards carry a $10 fee. Applications are submitted through the TransAction Portal (TAP).

Montana Cannabis Tax Rates

Montana imposes cannabis taxes exclusively at the retail level. Adult-use marijuana is taxed at 20% of net retail sales — calculated on the retail price after any discounts. Medical marijuana is taxed at 4% of net retail sales. Both taxes are collected and remitted by the dispensary on a monthly basis through the TransAction Portal. There is no tax on wholesale transfers between licensed businesses; the tax obligation arises only when cannabis is sold to an end consumer.

Local governments in Montana may adopt an additional local option cannabis sales tax of up to 3% on adult-use sales, subject to a local voter referendum. Of this additional local tax, 50% is retained by the county government, 45% is distributed to municipalities within the county by population, and the Department of Revenue retains 5% to cover administrative costs. Tax filings for zero-dollar periods still require a monthly return submission.

Residency, Ownership, and Background Check Requirements

Every individual applying for a cannabis business license must be a Montana resident and must have been a resident for at least one year prior to the date of application. Any individual holding a financial interest of 5% or greater in a licensed entity must be at least 21 years of age and must submit fingerprints for a state and federal background check as part of the application process. Background check submissions are required even for individuals who have previously submitted fingerprints for a prior CARD application. The 5% threshold applies to all ownership structures passive financial interests of 5% or greater are not exempt.

Following passage of Senate Bill 74 in May 2025, third parties performing work on behalf of a licensee must hold a valid worker permit and the licensee is directly responsible for the third party's compliance and liable for any violations the third party commits. Third-party relationships must be disclosed to the Department of Revenue at the time they are established.

Product Potency Limits

Montana sets statutory potency limits that apply to all licensed products in both the medical and adult-use markets. Adult-use marijuana flower may not exceed 35% Total Potential Psychoactive THC. Edible marijuana products intended for adult use may contain no more than 10 mg of THC per serving and no more than 100 mg of THC per package. Topical cannabis products may contain no more than 6% THC and no more than 800 mg of THC per package. A delta-9 THC variance of plus or minus 10% is permitted for manufactured ingestibles, non-ingestible infused products such as topicals, and concentrates and extracts this variance does not apply to flower, where the 35% cap is a hard ceiling.
