Cannabis in South Carolina is illegal.
In February 2024, the South Carolina Senate approved the South Carolina Compassionate Care Act, a bill to legalize medical marijuana, by a vote of 26-17. The bill, introduced by Republican Senator Tom Davis over a year ago, needs one more Senate vote for final passage before proceeding to the House for consideration. A similar measure passed in 2022 but was blocked in the House due to procedural issues.
However, the 2018 Farm Bill legalized CBD at the federal level and North Carolina followed suit under Senate Bill 52. In accordance with federal law, CBD sold and purchased in North Carolina must be derived from industrial hemp and contain less than 0.3% of THC — the psychoactive agent that causes intoxication.
