Texas Track-and-Trace Guide
Covering medicinal cannabis and the industrial hemp markets
Track-and-trace requirements in Texas 101
Texas currently does not have a government-mandated track-and-trace contract with a licensed third party, yet still requires self-reporting of seed-to-sale activities for all licensed medical cannabis products.
The Compassionate Use Act, signed into law in 2015, and has undergone several expansions since then. However, it remains one of the most restrictive medical cannabis programs in the United States.
The Compassionate Use Program (CUP) in Texas is overseen by the Department of Public Safety (DPS) under the guidelines of the Texas Health and Safety Code, Chapter 487. The program includes a secure online registry of physicians qualified to prescribe low-THC cannabis to patients with specific medical conditions. DPS also regulates the licensing of organizations that dispense low-THC cannabis to these patients through the Compassionate Use Registry of Texas.

What is the Texas track-and-trace system?
Texas' state-mandated system is designed to monitor the seed-to-sale movement of cannabis products throughout the supply chain, ensuring that all products are legally produced, transported, and sold within the state. However, Texas currently does not contract with a third-party track-and-trace system.
Who needs to use a track-and-trace system?
All licensed medical cannabis cultivators, manufacturers, distributors, and retail dispensaries in Texas are required to use the track and trace system to report their cannabis-related activities.
How does the track-and-trace system work?
The system uses unique identifiers (UIDs) for plants and packages to track cannabis products from cultivation through to the point of sale. Each entity in the supply chain must report various activities, including planting, harvesting, processing, transferring, and selling cannabis products.
What are the benefits of a track-and-trace system?
The system aims to prevent the diversion of cannabis into the illegal market, ensure product safety and quality, facilitate recall efforts if necessary, and assist in enforcing regulations regarding the legal cannabis market.
What happens if a business fails to comply with Texas's track-and-trace requirements?
Non-compliance can result in penalties, including fines, suspension, or revocation of the business's license to operate in the cannabis industry in Texas.
