Track-and-trace requirements in Georgia 101

Georgia currently does not have a government-mandated track-and-trace contract with a licensed third party, yet still requires self-reporting of seed-to-sale activities for all licensed medical cannabis products.

On April 17, 2019, Governor Brian Kemp of Georgia signed the Hope Act (HB 324) into law, permitting the safe access of low-THC medical cannabis oils (up to 5% THC) for patients within the state. Sales of these products started in the summer of 2023 through a limited number of dispensaries. Effort by the Georgia Access to Medical Cannabis Commission to broaden patient access included allowing independent pharmacies to offer medical cannabis products, but the Drug Enforcement Administration warned that participating pharmacies might lose their licenses for dispensing scheduled drugs. The impact of this warning on pharmacy participation remains unclear.

Additionally, in 2021, Georgia lawmakers passed SB 195, which expanded the range of permissible low-THC products to include tinctures, transdermal patches, lotions, and capsules, though edible products, vaporization, and raw flower consumption still remain illegal.
