Track-and-trace requirements in Nebraska 101
In 2015, Nebraska's LB643 proposed allowing medical marijuana in non-smokable forms for serious illnesses but was deferred to 2016 due to legislative priorities. Despite initial support, it was blocked by a Senate filibuster in 2016, facing opposition from Governor Ricketts and Attorney General Peterson. Additionally, a 2020 medical cannabis ballot measure in Nebraska failed, as the Supreme Court ruled it contained more than one question.
However, the 2018 Farm Bill legalized CBD at the federal level and Nebraska followed suit under Senate Bill 52. In accordance with federal law, CBD sold and purchased in Nebraska must be derived from industrial hemp and contain less than 0.3% of THC — the psychoactive agent that causes intoxication.
